Neptune Sexual Assault Sentence: 10 Years

I wrote an article in May about a Mercer County man who was convicted by a Monmouth County jury of first-degree aggravated sexual assault. Recently, the defendant was sentenced by the Honorable Ronald Lee Reisner, sitting in the Monmouth County Superior Court in Freehold, to 10 years in state prison. The defendant must serve eight and a half years before he will be eligible for parole. Following his release from prison, he must register under Megan's Law as a sex offender and he will be subject to parole supervision for life. In this case, the defendant must serve 8.5 years of the 10 year sentence, or 85%, because of the No Early Release Act. This statute essentially requires defendants to serve 85% of their sentence for certain violent offenses including murder, aggravated assault, and robbery. Otherwise, typically defendants serve approximately one-fifth (1/5) of their sentence in New Jersey. For example, for a first time drug offender who is sentenced to 5 years, he will typically serve about one year in prison. However, this is not the case for those offenses covered by the No Early Release Act.
